Welcome to Fetching. These Terms of Service and Terms of Sale (collectively, "Terms") are a legally binding agreement between you ("you" or "User") and FETCHING USA LLC, a Delaware limited liability company (together with its parent/affiliate Fetching Co., Ltd. (Republic of Korea), collectively "Fetching," "we," "us," or "our"), governing your access to and use of the Fetching website, mobile application, and related services (collectively, the "Platform").

BY CLICKING "I AGREE," CREATING AN ACCOUNT, OR MAKING A PURCHASE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY, INCLUDING THE BINDING ARBITRATION PROVISION IN SECTION 14 AND THE CLASS ACTION WAIVER IN SECTION 15. IF YOU DO NOT AGREE, YOU MAY NOT ACCESS OR USE THE PLATFORM.

These Terms apply to all visitors, registered users, and purchasers on the Platform.

Fetching operates as a cross-border e-commerce platform connecting users in the United States with designer fashion sourced from partner boutiques in Europe, the United States, Korea, and other regions. FETCHING USA LLC is the merchant of record for all U.S. transactions on the Platform.

All prices displayed are in United States Dollars (USD).

Products sourced outside the United States are imported and cleared through U.S. Customs and Border Protection, with FETCHING USA LLC serving as the Importer of Record.

To use the Platform, you must:

• Be at least 18 years of age (or the applicable age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding contract under applicable law
• Not be prohibited from receiving services under U.S. or applicable law
• Provide accurate and complete registration information

Users between the ages of 13 and 17 may access the Platform only with verifiable parental or legal guardian consent and supervision. We do not knowingly permit use of the Platform by children under the age of 13.

4.1 Registration

You may be required to create an account to access certain features of the Platform. You agree to provide accurate, current, and complete information and to promptly update such information if it changes.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to:

• Immediately notify Fetching of any unauthorized use of your account at help@fetchingshop.com
• Not share your login credentials with any third party
• Accept full responsibility for all activities conducted under your account

4.3 Social Login

If you register using a third-party social login service (e.g., Google, Apple), you authorize Fetching to access certain account information as permitted by that service and your privacy settings. You remain responsible for your account security.

4.4 Account Suspension & Termination

Fetching reserves the right to suspend or permanently terminate your account, without prior notice or liability, if we reasonably determine that you have violated these Terms or applicable law. Upon termination, your right to use the Platform immediately ceases.

5.1 Product Descriptions

Fetching takes reasonable efforts to ensure that product descriptions, images, pricing, and other information displayed on the Platform are accurate. However, we do not warrant that product descriptions or other content are error-free, complete, or current.

5.2 Availability

All products are subject to availability. Fetching reserves the right to limit quantities, discontinue products, or refuse any order at any time without liability.

5.3 Color & Display Accuracy

We cannot guarantee that the color or appearance of products as displayed on your device will accurately reflect the actual product. Variations in monitor settings may affect the display.

6.1 Pricing

All prices are displayed in USD and are subject to change without notice. Fetching reserves the right to correct pricing errors at any time. In the event of a pricing error, Fetching will notify you and you may choose to proceed at the corrected price or cancel your order.

All prices shown include applicable U.S. import duties (see §6.2). Sales tax is calculated at checkout based on your shipping address and shown as a separate line item before you place your order.

6.2 Duties and Sales Tax

Import Duties (DDP — Delivered Duty Paid). All prices on the Platform include applicable U.S. import duties and customs fees. Fetching ships on a DDP basis: there are no additional charges at delivery. FETCHING USA LLC is the Importer of Record for all shipments and is responsible for duty payments to U.S. Customs and Border Protection.

Sales Tax. Applicable U.S. state and local sales tax is calculated at checkout based on your shipping address and displayed as a separate line item before you confirm your order. Fetching collects and remits sales tax in states where we have established nexus, in accordance with each state's laws. If you are a tax-exempt organization, contact help@fetchingshop.com to set up your account accordingly.

6.3 Accepted Payment Methods

Fetching accepts the following payment methods:

• Major credit and debit cards (Visa, Mastercard, American Express)
• Apple Pay

All payments are processed by PCI-DSS compliant third-party payment processors. Fetching does not store full payment card numbers.

6.4 Order Confirmation

Receipt of an order confirmation email does not constitute acceptance of your order. A binding sales contract is formed when Fetching dispatches your order and sends a shipping confirmation.

7.1 Shipping Timeframes

Estimated delivery: 3–8 business days for orders shipped from U.S. partner shops, and 7–14 business days for orders shipped from international partner shops from order placement, including international transit and U.S. last-mile delivery. Delivery estimates are shown on product pages and at checkout.

Consistent with the FTC Mail Order Rule (16 C.F.R. Part 435), if we cannot ship within the stated timeframe, we will notify you and offer an updated delivery date or a full refund. Fetching is not responsible for delays caused by customs, weather, carrier issues, or other circumstances beyond our control.

7.2 Risk of Loss

Title and risk of loss for products pass to you upon delivery to the address you provided. Fetching is not responsible for loss or damage after the package has been signed for or marked as delivered by the carrier.

7.3 Address Accuracy and Delivery Limitations

You are responsible for providing an accurate and complete delivery address. Fetching is not responsible for failed deliveries resulting from inaccurate address information provided by you.

At this time, we do not ship to:

• P.O. Boxes
• APO / FPO / DPO addresses
• U.S. territories (Puerto Rico, Guam, U.S. Virgin Islands, Northern Mariana Islands, American Samoa)

Deliveries to Alaska (AK) and Hawaii (HI) are available but may require additional transit time.

8.1 Return Eligibility

You may return eligible items within 14 days of the delivery date, subject to the following conditions:

Please note: certain items are excluded from returns, including items marked "FINAL SALE" on the product page and the categories listed in Section 8.2 (Non-Returnable Items). Whether an item is eligible for return is indicated on each product page — please check before ordering.

• Items must be unused, unworn, and in their original condition
• All original tags must be attached
• Items must be returned in their original packaging
• The FETCHING authentication seal must be intact

Holiday Returns. For orders placed between November 1 and December 25, the return window extends to January 15 of the following year.

Defective or Incorrect Items. For items that are defective, damaged in transit, or shipped in error by us, the same 14-day return window applies, and we will provide a prepaid return shipping label at no cost to you.

8.2 Non-Returnable Items

The following items are final sale and cannot be returned or exchanged:

• Intimate apparel and swimwear (for hygiene reasons)
• Earrings and pierced jewelry (for hygiene reasons)
• Customized or personalized items
• Items marked as "Final Sale" on the product page
• Fragrances and beauty products that have been opened
• Gift cards
• Items with the FETCHING authentication seal removed

8.3 Return Process

To initiate a return, go to My Page > Orders > Request Return within the eligible return window. Once approved (typically within 2–3 business days), you will receive a prepaid return shipping label or a UPS QR code. Packages must be handed to UPS or FedEx within 7 days of label issuance.

8.4 Return Shipping Costs

Return shipping costs are not built into our product prices. Return shipping is charged only when a return is requested for reasons other than a defect or our error.

8.5 Refund Processing

Refunds will be processed to the original payment method within 10–14 business days of Fetching receiving and inspecting the returned item. Processing times may vary depending on your payment provider.

8.6 Exchanges

We do not offer direct exchanges for cross-border orders. To receive a different size or product, please return the original item and place a new order.

• Promo codes must be entered at checkout in the designated field
• Only one promo code may be applied per order
• Promo codes are non-transferable and have no cash value
• Fetching reserves the right to cancel or modify promotions at any time
• Misuse of promo codes may result in order cancellation and account suspension

10.1 Fetching Content

All content on the Platform, including but not limited to text, images, graphics, logos, software, and compilation thereof ("Fetching Content"), is owned by or licensed to FETCHING USA LLC and its affiliates and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of Fetching Content without our prior written consent.

10.2 Trademarks

The Fetching name, logo, and related marks are trademarks of FETCHING USA LLC and/or Fetching Co., Ltd. Nothing in these Terms grants you a license to use any Fetching trademark.

10.3 User-Generated Content

By submitting reviews, photos, or other content to the Platform, you grant Fetching a worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, display, reproduce, and distribute such content on the Platform for the purpose of operating, promoting, and improving the service. You represent that you own or have the right to grant this license and that your content does not violate any third-party rights.

This license terminates when you delete your content from the Platform, except to the extent copies are retained in backups, required by law, or already distributed to third parties under a valid sublicense.

10.4 DMCA Notice and Takedown

Fetching respects intellectual property rights and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512).

Notices must include all elements required under 17 U.S.C. § 512(c)(3). Counter-notifications may be submitted in accordance with 17 U.S.C. § 512(g). Accounts of repeat infringers will be terminated.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Platform or its related systems
• Use automated means (bots, scrapers, crawlers) to access or interact with the Platform without our prior written consent
• Submit false, misleading, or fraudulent information or reviews
• Infringe upon the intellectual property or other rights of Fetching or any third party
• Engage in conduct that is harassing, defamatory, obscene, or otherwise objectionable
• Interfere with the proper functioning of the Platform

Violation of this section may result in immediate account termination and may expose you to civil or criminal liability.

12.1 Disclaimer of Warranties

THE PLATFORM AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FETCHING DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FETCHING'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FETCHING IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

IN NO EVENT SHALL FETCHING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

12.3 Indemnification

You agree to indemnify, defend, and hold harmless Fetching and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any third-party rights.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy. For California residents, please refer to the CCPA/CPRA-specific disclosures in the Privacy Policy.

14.1 Agreement to Arbitrate

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, YOU AND FETCHING AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM — INCLUDING THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF — SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING INDIVIDUAL ARBITRATION, rather than in court.

14.2 Arbitration Rules & Process

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in the English language and, unless otherwise agreed, shall take place in the State of Delaware or via videoconference at the election of either party.

14.3 Arbitration Costs

Fetching will pay all AAA filing, administration, and arbitrator fees for any arbitration we initiate. For arbitration you initiate, filing fees shall be governed by the AAA Consumer Arbitration Rules. If the arbitrator finds your claim frivolous, you may be required to reimburse Fetching for its fees.

14.4 Opt-Out Right

YOU HAVE THE RIGHT TO OPT OUT OF THIS ARBITRATION AGREEMENT. To opt out, you must send written notice of your decision to opt out to help@fetchingshop.com within 30 days of first agreeing to these Terms. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration. If you opt out, all disputes will be resolved in court as provided in Section 16.

14.5 Exceptions to Arbitration

Notwithstanding the above, either party may seek:

• Relief in small claims court for disputes within the applicable jurisdictional limits
• Injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights or to protect confidential information

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FETCHING AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Further, unless both you and Fetching agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

If this class action waiver is found to be unenforceable as to a particular claim or request for relief, then that specific claim or request for relief shall be severed from the arbitration and may be litigated in court, while remaining claims shall proceed in arbitration.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

For any disputes not subject to arbitration under Section 14, you and Fetching consent to the exclusive jurisdiction of the state and federal courts located in Sussex County, Delaware.

Fetching reserves the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Effective Date" at the top of this page
• Notify registered users via email or prominent in-app notification at least 30 days before the changes take effect
• For material changes to the arbitration provision, provide an additional 30-day opt-out period

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.

18.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Fetching regarding your use of the Platform and supersede all prior agreements.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18.3 Waiver

Fetching's failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

18.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without Fetching's prior written consent. Fetching may freely assign these Terms in connection with a merger, acquisition, or sale of assets.
